Terms of Service

We design, build and host websites, provide a site editor, set up and run CRM, email, text messaging and booking tools, and build custom automations. What is included in your service is described in your order, proposal or agreement.

You must be at least 18 and able to act for your business. Keep your login details private; you are responsible for activity in your account, including by people you give access to. Tell us right away if you think your account has been misused.

You own the text, photos, logos and data you give us or add to your site or CRM. You give us permission to host, copy, display and adapt that content only as needed to provide your services. You confirm you have the rights to everything you provide and that it does not break any law or anyone else's rights.

You may not use our services to send spam, to send texts or emails to people who have not agreed to receive them, to collect information unlawfully, or to host illegal, deceptive or harmful content. If you send messages through the CRM, you are responsible for getting each contact's consent and for following the TCPA, CAN-SPAM, carrier rules and other messaging laws, including honoring STOP and unsubscribe requests. We may suspend messaging or accounts that put our services or other clients at risk.

If you agree to receive texts from Pragmateia, we send messages about your project, appointments and account, plus occasional offers if you separately opt in to marketing texts. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Consent is not a condition of purchase. See our Privacy Policy for how we handle your number.

Prices and payment terms are set out in your order or agreement. Monthly plans renew automatically until you cancel, and cancellation takes effect at the end of the current billing period. Unless your agreement says otherwise, fees already paid are non-refundable. If a payment fails, we may pause the service until it is resolved.

Some features rely on other companies, such as hosting, payment, domain, email and text messaging providers. Their own terms also apply, and we are not responsible for their outages or decisions, such as a carrier blocking a message.

We work to keep everything running, but we provide our services “as is” and do not promise they will be uninterrupted or error-free, or that they will produce particular business results such as rankings, leads or sales.

To the fullest extent the law allows, Pragmateia is not liable for indirect, incidental or consequential damages, or for lost profits, revenue or data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.

You agree to cover Pragmateia for claims and costs that arise from your content, your messages to your contacts, or your breach of these terms.

You can stop using our services at any time. We may suspend or end service if you break these terms or do not pay. When service ends, we will give you a reasonable chance to export your content and contacts, unless the law prevents it.

These terms are governed by California law, and any dispute will be handled in the courts of California. We may update these terms; the date at the top shows the latest version, and continuing to use the services after a change means you accept it.
